What is the BKR disputes committee?
Do you want to remove your BKR registration? Then the BKR, banks and lenders often refer you to the BKR Disputes Committee. This committee consists of a number of committee members and assesses your file. They do this on the basis of the General Regulations of the BKR. Based on these regulations it is decided whether you are eligible for a registration removal. Do they find that the registration is justified? Then it will simply remain in place.
The disputes committee is funded by the Bureau of Credit Registration. This therefore ensures that you can file an objection for only fifty euros. So the costs remain fairly low and if you are found to be in the right, you will even get these costs back. So why is it not always smart to take up a case via the disputes committee?
Risk BKR removal through the Dispute Resolution Board
It is not always advisable to file an objection through the BKR Disputes Committee. One reason is that the decision of the dispute committee is binding. If the committee decides that the registration is justified, you will have to accept it. This means that you cannot appeal or take any subsequent legal action. This immediately eliminates your future opportunities. In addition, the chances of being vindicated by the litigation committee are very slim. Do you benefit greatly from the removal of BKR registration? Then it is better to do it through another route to increase your chances. The path through the dispute committee is often long and offers no guarantee of success. To still achieve the desired result, we recommend that you start proceedings through the court.
