What are personal data?

What personal data are processed?

To provide our services we need various personal data, including your name, name and address details, contact details and financial data such as pay slips, bank details etc. Dynamite Netherlands only processes personal data in accordance with the purpose for which it was provided, being our legal work based on the agreement concluded with you and for our relationship management. Depending on the content of our services, we may need additional personal data. For example, in the event that you are potentially eligible for subsidized legal aid, we may also need your citizen service number, marital status, e-mail addresses and telephone numbers, and information regarding income, assets and debts, from both you and your partner. The processing of your personal data is limited to only those personal data that are minimally necessary for the purposes for which they are processed. When necessary for our services, we provide your personal data to third parties. Examples include requests that we submit to opposing parties on your behalf, court documents sent to the bailiff and court, on which various personal data must be included.

Obtaining personal data

By entering into an agreement with us, you consent to the processing of your personal data. You have the right to withdraw this consent at any time. In addition, the personal data we obtain may come from: judicial or municipal authorities, public registers such as the Land Registry, BKR or the Chamber of Commerce, involved (legal) persons or bailiffs.

Your information obtained by us from others

Suppose your partner also wants to use our services on your behalf. Then we may use the personal data we request about you, and in some cases we are even required to do so. It may also be data from other sources. For example:

  • (public) records that contain your information;
  • public sources such as newspapers, the Internet and portions of social media that are not private;
  • files of other parties who have collected data about you, such as third-party marketing agencies, trade information agencies, or (former) lenders.

Exchange of personal data with third parties

Without your express, prior written consent, we will not provide your personal data to third parties, unless it is necessary for the performance of our work and when required and permitted by law. For example, for the initiation of proceedings or mail delivery. Dynamite Netherlands uses the Alexion CRM program in the execution of its work. Your personal data are also stored in this program. Agreements on data exchange are laid down in a processing agreement with Alexion. The personal data may only be used for the purpose described in the processing agreement. We do not provide personal data to parties located outside the European Union.

Security

Dynamite Netherlands has taken appropriate technical and organizational measures to secure your personal data. We strive to prevent loss or unlawful processing. If a 'data leak' does occur, we will notify the Personal Data Authority if necessary. If we deem it necessary and there is a significant risk of misuse of the 'leaked' personal data, we will also notify you.

We keep your personal data with care and adhere to the retention periods set by law. Dynamite Netherlands will not keep your personal data longer than is necessary for the purpose for which it was provided or required by law.

Your rights

When we process your data, as a data subject you have certain rights. Among other things, you have the right to information about the processing operations, the right to access your personal data, the right to correct your personal data if it is incorrect, the right to delete your personal data and the right to be forgotten. In addition, you have the right to request us to transfer your personal data to a third party. As a data subject, you can also object to the processing of all or part of your personal data.

To optimize and analyze our services, we use only functional "cookies. Dynamite Netherlands uses Google Analytics, a program that places "cookies" on your computer to help our websites www.dynamiet.nl analyze how visitors use the websites. Data from Google Analytics is stored for 14 months. In addition, Dynamite Netherlands has "data sharing" turned off. Glossary Privacy statement

The Data Protection Officer: oversees the application of and compliance with the AVG within the organization of Dynamite Netherlands. The Privacy Statement states that in a number of specific cases you may contact the Privacy Office with questions about the use of your personal data.

Special Personal Data: The law lists special personal data as follows:

  • personal data from which race or ethnicity;
  • political views;
  • religious or philosophical beliefs;
  • prove membership in a union;
  • genetic data;
  • biometric data for the purpose of uniquely identifying an individual;
  • health data;
  • data relating to a person's sexual behavior or sexual orientation;
  • criminal history data.

Profiling: The Privacy Act defines "profiling" as follows : "Any form of automated processing of personal data in which certain personal aspects of a natural person are evaluated on the basis of personal data, in particular with the aim of analyzing or predicting professional performance, economic situation, health, personal preferences, interests, reliability, behavior, location o travel." Thus, the law allows profiling. This is a general definition that also applies to other responsible parties under the Privacy Act. EU list of safe countries:The European Commission (EC) has designated a number of countries outside the EU that have a comparable level of protection. The Personal Data Authority publishes this list on its website.
