Client Dynamite wins case over access to own personal data

In March 2017, client reports to Dynamite Netherlands, he has a negative BKR registration and doubts that it is justified.

Inspection of file denied

Dynamiet immediately launched an investigation and wrote to the registering party requesting access to the client's file. Within a week Dynamiet received an answer from collection agency Unisolve from the registering party: the documents will not be shared. This is because Dynamite is an administrative burden for all lenders AND Dynamite is abusing the right of inspection, according to Unisolve.

Client decided to initiate legal proceedings to claim the documents through the court. The hearing was on Oct. 17, 2017.

Client's right to inspect

Within two days the judge was out; client simply has the right to inspect the documents. The other party must provide access to the entire file within two weeks and pay the costs of the proceedings.

A day after receiving the ruling, Unisolve sent the documents.
