2: Appeal to get rid of your BKR registration
To object to a BKR registration yourself, it is first important to have a clear picture of how you are registered. To do this, you can view your credit data yourself (free of charge) through the BKR.
Next is to determine whether the BKR registration is justified or not. For example, is there a late payment record that has long since been cleared? Then it may pay off to file an objection.
You do so with the lender to which the registration relates:
- Please state why you disagree with the registration;
- Describe what adverse effects this will have on you (for example, difficulties in obtaining a mortgage);
- Whenever possible, substantiate your objection with documentation that proves you are right.
Even in the case of a justified BKR registration, it is in many cases possible to get rid of it. At Dynamite Netherlands we are specialized in this.
3: Getting rid of your BKR registration through the Dispute Resolution Commission
Are you and the lender not getting along and disagreeing with the BKR registration? Then a step to the Geschillencommissie-BKR or the court is your next option. Below we explain the step to the Dispute Commission in a nutshell.
You initiate proceedings with the Dispute Resolution Committee by submitting a letter of complaint, describing the situation and your grievance as clearly as possible. You should also attach a copy of the original correspondence with the lender.
Please note that going to the Dispute Commission is not always easy and is time-consuming. On average, proceedings take 12 months. In addition, the Dispute Commission makes a binding ruling. This means that you and the lender must abide by the ruling.
