Peer-to-peer lending without BKR: a real solution or false security?

Borrowing with BKR

You've heard about peer-to-peer lending as an alternative for people with a BKR registration. It sounds appealing: borrowing money from private individuals via a platform, without banks or the BKR getting involved. But how does it work in practice? And more importantly, does it really solve your problem?

What is peer to peer lending without BKR?

Peer-to-peer lending (P2P) is a form of lending in which you borrow money from private investors via an online platform. The platform brings together borrowers and investors, without the involvement of a bank. Because some P2P platforms position themselves as intermediaries rather than lenders, they are not subject to the mandatory BKR credit check.

That's the theory. And it's precisely that theory that makes P2P lending popular among people with a BKR registration. Finally, a way to borrow money without your past getting in the way, right?

Not entirely.

Why P2P lending is rarely the solution you are looking for

Let's be honest about what you'll encounter if you go down this route.
The costs are high. Investors on P2P platforms take a risk by lending money to people who are rejected by banks. They want to be compensated for that risk. The result: interest rates that are significantly higher than for regular loans. You pay a premium for circumventing the system.

Protection is minimal. P2P platforms that operate outside the Wft offer less consumer protection than banks. There is no deposit guarantee. If the platform goes bankrupt, you are on your own. And in the event of payment problems, you have fewer rights than with a regular lender.

The gray area is shrinking. The financial sector is becoming increasingly regulated. Platforms that currently operate without credit checks may soon be subject to new EU regulations. You are building on quicksand.

You are not solving the underlying problem. This is the most important point. Suppose you take out a loan via P2P. You have money, but your BKR registration still exists. The next time you want to take out a mortgage, sign up for a phone contract, or need business financing, you will run into the same wall again.

“People seek out P2P lending because they think their credit rating is something they just have to live with. But in many cases, that rating is legally contestable. It’s better to tackle the problem at its root than to work around it.”

The real question: why do you have a BKR registration?

If you are looking for ways to borrow money without a credit check, chances are that your registration is bothering you. Perhaps you had a payment delay years ago due to circumstances beyond your control. Maybe you have since paid everything off. But that registration will continue to haunt you for five years.

What many people don't know: a BKR registration does not have to remain on file for five years.

The Supreme Court has ruled that BKR registrations must be proportionate. The impact on your life must be reasonably proportionate to the original debt. If this is not the case, the registration can be removed.

When can you have your BKR registration removed?

You have legal grounds if:

  • The delay was caused by circumstances beyond one's control, such as illness, dismissal, or divorce.
  • You have now repaid the debt in full.
  • Your current financial situation is stable
  • The registration disproportionately hinders you, for example when buying a house.
  • The registration is factually incorrect or you have not been correctly informed

This is not a theoretical possibility. Dynamiet Nederland has helped thousands of people have their registrations removed. No detours via P2P platforms or expensive mini-loans. Just access to normal credit terms again, with normal interest rates.

“I regularly speak to people who have been searching for alternative forms of credit for months. They have spent hours on P2P platforms, comparing mini-loans, and researching private lenders. During that same time, they could have had their BKR registration removed. That would have solved the problem instead of just circumventing it.”

The choice is clear

You can keep looking for ways to circumvent the BKR system. P2P lending, mini loans, private lenders. They all exist. But you pay more, you get less protection, and your problem remains.

Or you can investigate whether your BKR registration can be removed. Address the cause once and for all, instead of constantly fighting the symptoms.
