Dynamite battles ING over BKR registrations

Legal service provider Dynamiet Netherlands is fed up with ING structurally disadvantaging its (former) customers with a BKR registration. That is why Dynamiet Netherlands offers help for duped people with a BKR registration from ING. Director Deepak Thakoerdien: "We will fight like a tiger against the bank with the orange lion."

Dynamite Netherlands calls on ING victims. "Are you, or were you, an ING customer? And do you have a BKR registration you want to get rid of because you are financially healthy, but can't buy a house, or finance a renovation, or otherwise borrow money? Then report to Dynamite Netherlands. If you earn less than modal, we will help you challenge that registration absolutely free of charge."

It has long been a thorn in the side of the largest opponent of BKR registrations, Dynamite Netherlands, that ING categorically refuses to cooperate with removal requests. This while a BKR registration can have major consequences for buying a house or taking out a responsible loan, i.e. for the future. Thakoerdien: "The employees at Dynamite Netherlands speak to people every day who are powerless and even hang on the phone crying because of ING's unjust and heartless policy. Often it is a finicky, cleared arrears from the past that causes, for example, a purchase contract for a house to be dissolved. We see the bank causing people a lot of stress and suffering. In addition, the bank is unnecessarily driving up people's costs for a lawsuit or grievance procedure. We can no longer allow this. This must stop."

What is going wrong at ING?

If a BKR registration is unreasonably onerous, you can object to the lender who placed the registration. The lender must then make a balancing of interests based on the objection. When balancing interests, the lender must judge whether it is still necessary to keep someone registered any longer.

In principle, ING rejects all objections from people. ING's verdict is almost always in favor of the bank and against the person who wants to buy a house. The bank wins and the customer loses, says Thakoerdien.

What exactly is a balancing of interests?

Another big problem is: ING routinely registers people wrongly with particularity code 3. This code is heavier than all other codes at BKR.

But ING punishes you even more if you actually request the removal of code 3. "Then the bank treats you to an additional code 2." Huh? Exactly! The bank not only refuses to remove the code 3, but in the process retroactively places a code 2 after your name that the bank "forgot" to report. Subsequently, you are even worse off than before.

What does particularity code 3 stand for? Code 3 stands for a write-off of €250 or more on the outstanding loan by the bank. In other words, the customer has not repaid that amount or more on their loan. But often this is not the case at all. ING has been condemned several times by the former Geschillencommissie-BKR and financial complaints institute Kifid for placing, or maintaining, an unjustified code 3. Nevertheless, the bank refuses to remove this code at the request of the customer. Thakoerdien: ""Of all the ING applications we receive daily, at least eighty percent suffer from an unjustified code 3.""

10-0 behind

As a customer, you are then 10-0 behind when you finally start proceedings against ING. For lawsuits, the bank hires an expensive law firm from the Amsterdam Zuidas. They pull out all the stops to win the case for ING. For procedures with the Kifid complaints body, the bank engages two specialized employees. With the sole purpose of rejecting the removal request.

What do we do?

Anyone with an unreasonable or unjustified 3-count can apply to us. We work on the basis of the graduated scale of the Legal Aid Board (R vR). Where the RvR asks for an own contribution, we work completely free of charge for people who earn less than the modal income (up to € 29,400). Initially for legal mediation without court intervention. Should litigation nevertheless be necessary, we work on a pro bono basis. In that case we do ask for a relatively small own contribution in accordance with the rules of the RvR. For people earning more than € 29,400, we will assess the total costs on a case-by-case basis. Also in that case you know in advance where you stand. No nasty surprises afterwards.

Investigation via the Personal Data Authority
We are in discussions with the Personal Data Authority (AP) about ING's practices. We will report any unjustified or unreasonable coding to the AP. We expect to be able to tell you more about this at a later stage.
